Terms of service
Effective date: October 20, 2026
Welcome to The Binder Base. These Terms and Conditions ("Terms") explain the rules for using our online store at https://binderbase.myshopify.com (the "Store") and for buying our products. The Store is operated by The Binder Base ("The Binder Base", "we", "us" or "our"), a business based in Texas, USA.
Please read these Terms before you buy. By placing an order or using the Store, you agree to these Terms, our Privacy Policy and our Refund Policy. If you don't agree, please don't use the Store or place an order.
The short version: our digital files are for your personal use only, you're free to trade or sell overlays you printed for your own collection, commercial reproduction of our designs isn't allowed, all digital sales are final, and our products are fan-made and not official Pokémon merchandise. The full details are below.
1. Who can buy
You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, a parent or guardian must place the order and agree to these Terms on your behalf, and they are responsible for how the files are used.
You agree to give us accurate, complete information at checkout (including a working email address, because that is how your files are delivered) and to keep any account details secure. You are responsible for activity under your account.
2. Our products
Digital products. Most of what we sell are printable digital downloads, such as full-art card overlays supplied as PDF print sheets plus a print-and-cut guide. Each product page lists what's included, for example the paper sizes (US Letter and A4), pocket sizes and languages. Nothing physical ships for a digital product.
Physical products. We may also sell physical goods in the future, such as UV-printed zip binders and custom sleeves. Section 9 and our Refund Policy cover those.
Descriptions and colours. We work hard to describe and show every product accurately. Printed results depend on your printer, ink, paper, settings and screen, so colours, sharpness and cut accuracy can differ from our photos and previews. We don't guarantee that printed output will match what you see on screen exactly.
Availability and errors. We may change, update or stop selling any product at any time. If we make a mistake in a description, price or availability, we may correct it and, where an order hasn't been fulfilled yet, cancel it and give you a full refund for that order.
3. Prices, payment and taxes
Prices are shown in the Store's currency at checkout. Applicable sales tax, VAT or GST is calculated at checkout based on your location. Payment is taken in full when you place your order and is processed by Shopify and its payment partners (for example Shopify Payments, PayPal, Apple Pay or Google Pay). We never see or store your full card number.
We may refuse or cancel any order, for example if we suspect fraud, an unauthorised transaction, reselling or a breach of these Terms. If we cancel an order before delivery, we refund the full amount paid.
4. Digital delivery
After your payment is confirmed, you'll receive an email with a download link, and the link usually also appears on your order confirmation page. Delivery is normally immediate, but it can take a little longer if a payment needs extra checks.
Download links may be limited to 5 downloads and may expire after 30 days. Please download your files promptly and keep your own backup copy. If your link expires, stops working or never arrives, email us at help@thebinderbase.com with your order number and we'll send you a fresh link.
You are responsible for having a compatible device, software (for example a PDF reader), a printer and suitable paper or sticker stock to use our files. Check the product page and the print-and-cut guide before you buy.
Your order is treated as delivered once the download link has been sent to the email address you gave at checkout.
5. Your license to use our files
This section is important. Please read it carefully.
When you buy a digital product, you are buying a license to use the files, not ownership of the files or the artwork. We (or our licensors) keep all rights not expressly given to you below.
What you may do
We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- download the files and keep copies on your own devices for backup;
- print the files, at home or at a print shop acting for you, as many times as you need;
- use the printed overlays in your own personal collection, for example in your own binders, sleeves and toploaders; and
- trade, gift or sell overlays you printed for your own collection on a personal basis, the way any collector trades or sells items from their collection. For example, you can swap overlays with a friend, trade them at a meetup, or sell a card with its overlay still on it.
The license is for one person: the buyer. If someone else wants the files, they need to buy their own copy. The freedom to trade or sell personally covers physical overlays you printed for your own collection. It doesn't cover the files themselves, or printing overlays in order to sell them (see below).
What you may not do
You may not, in whole or in part:
- Redistribute or share the files, or any copy of them, with anyone else. This includes emailing them, posting them in group chats, Discord servers or social media, or sharing download links.
- Upload the files to any file-sharing site, cloud folder shared with others, torrent, print-sharing community or public library of any kind.
- Alter or modify the files or artwork and then share, publish or sell the result. This includes editing, recolouring, cropping, tracing, removing our branding, footers or notices, or combining our art with other work. You may resize or rearrange the files only to print them for your own collection.
- Resell, sublicense, rent, lend or transfer the files or this license, including as part of a resale of anything else you bought from us.
-
Reproduce the designs commercially. This means printing or making copies of the overlays in order to sell them, or using the files or designs for any business purpose. This includes:
- printing overlays to sell, singly, in sets, in bulk or as a printing service for other people;
- running a shop, stall, listing or storefront that offers overlays printed from our files;
- printing overlays to add as a bonus, upgrade or selling point to cards, binders, sleeves, lots, breaks or "mystery" products you sell as a business;
- uploading the designs to any print-on-demand service or marketplace (such as Etsy, eBay, Redbubble, TikTok Shop or Amazon);
- bundling the files or printed overlays with any product, course, template pack, membership or promotional giveaway; and
- using the designs in advertising, branding or product listings (other than a listing for a card or item from your own collection that has one of your printed overlays on it).
- Use the files, artwork or printed output to train, fine-tune or prompt any AI or machine-learning model, or to make NFTs or other digital tokens.
- Claim the artwork as your own, or remove or hide any credit, watermark, footer or notice on the files.
Showing photos or videos of your own collection, including overlays you printed, on social media for non-commercial purposes is fine. We'd love a tag at @binderbase, but it's not required.
If the license is broken
If you break this section, your license ends automatically and immediately, without notice and without a refund. You must then stop using and delete every copy of the files. We may also cancel your access to future downloads, refuse future orders, send takedown notices, and take any other action available to us by law.
Our Refund Policy also applies to license breaches: no refund is given for a purchase whose license has ended because of a breach.
6. Fan-made products and trademarks
Our products are unofficial, fan-made works. The Binder Base is not affiliated with, endorsed by, sponsored by or approved by The Pokémon Company, The Pokémon Company International, Nintendo, Creatures Inc. or GAME FREAK inc.
Pokémon, Pikachu, the Pokémon Trading Card Game, and all related names, characters, artwork, logos and trademarks are the property of their respective owners. They are referred to in our Store only to describe what our products fit or are designed to go with. Nothing in our Store grants you any rights in those trademarks or that intellectual property.
Our overlays are decorative accessories made to sit over cards you already own. They are not trading cards, are not legal for tournament play, and must not be used to pass off any card as genuine, graded, altered-official or of a different rarity or condition. Please don't use our products to mislead anyone about what a card is.
The license in Section 5 covers only the rights we have in our own original contributions to the designs. If any rights holder asks us to stop selling a product, we may remove it from the Store at any time. Products you have already bought remain covered by Section 5, unless we are legally required to say otherwise.
7. Our intellectual property
Apart from the third-party trademarks described in Section 6, everything in the Store, including our original artwork and border designs, print layouts, guides, photos, text, The Binder Base name and logo, and the Store's design, belongs to us or our licensors and is protected by copyright, trademark and other laws. You may not copy, reproduce or use it except as these Terms allow.
If you believe something in our Store infringes your rights, email help@thebinderbase.com with the details and we'll look into it promptly.
8. Refunds
All sales of digital products are final, and we do not offer refunds on digital downloads once they have been purchased and delivered. If you have a problem with a file, we'll help: we can resend your link or replace a file. The full rules, including how we handle damaged or defective physical items, are in our Refund Policy, which forms part of these Terms.
9. Physical products
This section applies only when we sell physical products, such as UV-printed zip binders and custom sleeves.
- Made to order. Many physical products are printed or made to order. Production times are shown on the product page and are estimates.
- Shipping. Shipping costs and estimated delivery times are shown at checkout. Delivery dates are estimates, not guarantees, and carriers can be delayed.
- Risk and ownership. Risk of loss passes to you when the carrier delivers the package to the address you gave us. Ownership passes to you when we receive full payment.
- Address. Please check your shipping address carefully. We aren't responsible for orders sent to an incorrect address you entered.
- Customs and import duties. International orders may be charged import duties, taxes or fees by your country. These are your responsibility unless the checkout says otherwise.
- Custom orders. If you send us text, images or other content for a custom product, you confirm that you own it or have permission to use it, and that it doesn't infringe anyone's rights or break any law. We may refuse any custom request at our discretion.
- Damaged, defective or wrong items. See the physical products section of our Refund Policy.
10. Chargebacks and payment disputes
If you have a problem with an order, please contact us first at help@thebinderbase.com. Most issues can be fixed quickly. If you open a chargeback or payment dispute for a digital order that was delivered as described, we'll provide the payment processor with proof of purchase and delivery, including download records. We may suspend your access to downloads and future orders while a dispute is open. Filing a dispute doesn't change the license terms in Section 5.
11. Reviews and content you send us
If you post a review, photo or comment on our Store, or send us content (for example a photo of your binder), you give us a non-exclusive, worldwide, royalty-free license to use, display and share it in connection with The Binder Base, including on our Store and social media, with credit where practical. You confirm the content is yours to share and that it isn't unlawful, misleading or offensive. We may remove any content at our discretion. We will ask before using photos that show your face or personal details.
12. Acceptable use of the Store
You agree not to:
- use the Store for any unlawful or fraudulent purpose;
- try to get around download limits, payment, security or access controls;
- scrape, copy or harvest content or data from the Store with bots or automated tools;
- introduce viruses or malicious code, or interfere with the Store's operation; or
- impersonate anyone or give false information.
13. Third-party services and links
The Store runs on Shopify and uses third-party services for payments, file delivery, email and analytics. Your use of those services may be subject to their own terms. Our Store may link to other websites, such as our social media accounts. We aren't responsible for third-party websites or services.
14. Disclaimers
To the fullest extent permitted by law, the Store and our products are provided "as is" and "as available". We make no warranty that the Store will be uninterrupted or error-free, or that our files will be compatible with every printer, paper, cutter, sleeve or setup. Except as stated in these Terms, and except for any warranties that cannot be excluded by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Printing and cutting involve tools such as blades, cutters and UV printers. Follow the manufacturer's safety instructions. You are responsible for your own equipment, materials and safety, and for any cards you handle. Always test fit on a spare or low-value card first.
15. Limitation of liability
To the fullest extent permitted by law:
- we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill, or damage to cards, collections, printers or other property arising from your use of the Store or our products; and
- our total liability for any claim relating to an order is limited to the amount you paid for that order.
Some places don't allow some of these limits, so they may not apply to you. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
16. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless The Binder Base and its owners from any claims, losses, damages and costs (including reasonable legal fees) arising from your breach of these Terms, including any misuse, sharing or resale of our files, or from content you provide for custom orders.
17. Suspension and termination
We may suspend or end your access to the Store, your account or your downloads at any time if you break these Terms or if we reasonably suspect fraud or misuse. Sections 5 (what you may not do and license breach), 6, 7, 10 and 14 to 20 continue to apply after termination.
18. Governing law and disputes
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. If a dispute arises, please contact us first at help@thebinderbase.com so we can try to resolve it informally. If we can't resolve it within 30 days, either of us may bring a claim in the state or federal courts located in Texas, and you and we agree to their jurisdiction. Either of us may instead bring an eligible claim in small claims court.
If you are a consumer living in the European Union, the United Kingdom or another country with mandatory consumer protection laws, you keep the protection of those laws and may bring proceedings in the courts where you live.
19. Changes to these Terms
We may update these Terms from time to time. The version posted on the Store when you place an order applies to that order. We'll update the effective date at the top when we make changes.
20. General
- Entire agreement. These Terms, our Privacy Policy and our Refund Policy are the whole agreement between you and us about the Store and your purchases.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we don't enforce a right straight away, we haven't given it up.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example if our business is sold.
- Events outside our control. We aren't responsible for delays or failures caused by events beyond our reasonable control, such as outages at Shopify or a carrier.
